On January 12, 2014, Brookhaven Police responded to a domestic dispute at Mr. Gervais residence. During this dispute, his then-girlfriend ("K.R") told police that Mr. Gervais had pushed her off of the third floor balcony.

Ms. K.R told the officer that Mr. Gervais had assaulted her, resulting in injuries, while Mr. Gervais also told police that Ms. K.R had struck him. Showing visible injury, Ms. K.R denied medical attention and requested to be transported to the residence of Mr. X.X, a friend of Ms. K.R.

Mr. X.X, concerned for her well-being, provided temporary accommodation for his friend by allowing her to stay at his residence. Mr. X.X also gave her money so that she could return to her hometown in Tennessee, buy a new phone, and replace all of her clothes, since Gervais had thrown her belongings in the trash.

On the subsequent day, January 13, 2014, Mr. X.X found himself on the receiving end of harassing phone calls and text messages from Mr. Gervais.

Court transcripts pertaining to a later incident between Mr. X.X and Mr. Gervais shed light on the intentional nature of the texts, which were designed to provoke Mr. X.X. Despite receiving numerous phone calls from Mr. Gervais, Mr. X.X opted not to respond. These texts also unveil Mr. Gervais' demand for immediate repayment of a $5,000 debt, claiming that Ms. K.R owed him for a trip he willingly took her on.

Following the text messages, Mr. Gervais engaged in a series of harassing emails and texts directed at Ms. K.R on multiple occasions. Some of these messages explicitly threatened legal action, including the prospect of throwing her in jail, should she failed to repay the alleged debt. Upon receiving the aforementioned messages, Mr. X.X took immediate action by obtaining a warrant against Mr. Gervais, citing terroristic threats to "shoot [Mr. X.X] in the face." Furthermore, Mr. X.X filed a police report detailing an incident that occurred subsequent to the threats made by Mr. Gervais. According to the report, an unidentified black male entered Mr. X.X office and inquired about Mr. X.X's whereabouts. When informed that Mr. X.X was not present, the male brandished a firearm while stating, "tell him to stay away from [Ms. K.R], and that I'm looking for him."

After the threats made to Mr. X.X, on February 3rd, 2014, Mr. Gervais reportedly challenged Mr. X.X to a boxing match upon learning about Mr. X.X's visits to the Atlanta Boxing Gym. Concerned about the situation, Mr. X.X expressed his concern to Ms. K.R through a text message.

Mr. X.X ultimately accepted the challenge, leading both men to convene at the Atlanta Boxing Gym. At this time, Ms. K.R had reconciled with Mr. Gervais so she was physically present with him during the time leading up and during the match.

Mr. Gervais willingly signed a waiver and stepped into the ring to face Mr. X.X. There is evidence to suggest that in previous interactions with Mr. X.X, Gervais made it clear that he was experienced in Karate, so as to imply that he would win the match. With the intention of resolving their disputes, the two individuals engaged in a match. Following the fight, Mr. X.X even accommodated Gervais by taking a picture with him as a conciliatory gesture as Gervais stated that he had never been in a boxing gym before.

However, upset by the perceived outcome of the match, Mr. Gervais called the City of Atlanta Police while outside of the boxing gym. He alleged that he was assaulted as soon as he entered the boxing gym. Atlanta police arrived but did not question Mr. X.X, nor did they go into the gym to investigate the incident. It was then determined that Gervais came to the gym armed as Atlanta police found a gun in his vehicle. This discovery, along with an existing warrant for terroristic threats, prompted Atlanta Police to arrest Gervais. Ms. K.R was also arrested for an existing warrant that Gervais had previously taken out on her.

False Testimony

Mr. Gervais continued in his attempts to trouble Mr. X.X by initiating a criminal case against him approximately seven months after the boxing match. He applied for a magistrate warrant, claiming that he had been assaulted by Mr. X.X at the boxing gym.

A probable-cause hearing took place on September 12, 2014, to evaluate the merits of Gervais' warrant application. However, during the hearing, multiple eyewitnesses and evidence refuted Gervais' claims. Despite this conflicting evidence, Mr. X.X was arrested, and the case was subsequently forwarded to the Fulton County District Attorney's Office for prosecution.

Notably, Mr. Gervais displayed a lack of cooperation with the prosecution of the case. He failed to appear in hearings and did not actively participate during the discovery phase.

In addition to poor cooperation with the criminal case that he initiated, Mr. Gervais also filed a civil complaint seeking $1,000,000. However, this complaint was dismissed with a fee award in favor of Mr. X.X. on March 8, 2021, at the request of the State, a nolle prosequi was requested and granted for Mr. X.X in relation to the accusations of assault.

In January 2022, Mr. X.X filed a civil suit, seeking compensation for the emotional, psychological, a nd financial burdens caused by Mr. Gervais. Through a Complaint for Damages, he aimed to hold Mr. Gervais accountable for his actions.

Willful Contempt

In July of 2023, the Chief Judge of the State court of Dekalb County found Gervais in willful contempt, ordered him to be incarcerated, and awarded attorneys' fees totalling $3,871.

Gervais was deemed to be in willful contempt as a result of his inability to answer, while under oath, inquiries concerning his assets. He indicated the possession of assets situated outside of the U.S. However, when directed to specify these assets, Gervais only revealed two properties in Atlanta, failing to address his assets outside of the country.

During document production, Gervais claimed to have none available. Yet on January 3rd, 2023 he provided select statements from a Wells Fargo Checking which did not fully respond to the courts request for 24 months of statements for the account.

Gervais neglected to provide statements from an account linked to Mizhou Bank in Japan. Adding to this, he did not furnish documents concerning his other accounts w ith Wells Fargo and accounts located in Japan, Vietnam, or Cambodia. Gervais claimed that he is unable to produce statements from these accounts, but the court did not find this claim credible.
